1. Introduction Welcome to Dream Moment! These terms and conditions outline the rules and regulations for the use of Dream Moment’s website and the services we offer. Services Dream Moment offers a range of photography and videography services, including but not limited to wedding photography, pre-wedding shoots, fashion photography, modeling, cinematography, videography, ad shoots, and makeup artistry. The scope of the services will be outlined in the contract signed by both parties prior to the commencement of any project.
3. Booking and Payment Booking: A booking is considered confirmed once a deposit is received. The deposit amount and payment schedule will be specified in the contract. Payment: The remaining balance must be paid in full before the final delivery of the photos or videos. We accept payments via bank transfer, credit/debit cards, and other methods as agreed upon. Cancellation and Refunds: In case of cancellation by the client, the deposit is non-refundable. Refunds for any other payments will be subject to the terms specified in the contract.
4. Intellectual Property Rights All content provided by Dream Moment, including but not limited to photographs, videos, and digital media, is the intellectual property of Dream Moment. Clients are granted a non-exclusive, non-transferable license to use the content for personal or commercial purposes, as agreed in the contract. Clients may not alter, reproduce, or distribute the content without prior written consent from Dream Moment.
5. Client Responsibilities Clients are responsible for ensuring that all necessary permissions, consents, and releases are obtained for the subjects and locations involved in the photoshoot or video production. Dream Moment will not be held liable for any claims arising from the failure to obtain such permissions.
6. Delivery and Storage Delivery: Final images and videos will be delivered within the timeline specified in the contract. Dream Moment will deliver the final product in a digital format unless otherwise agreed upon. Storage: Dream Moment will retain copies of the final deliverables for a period of six months from the date of delivery. After this period, we cannot guarantee the availability of the files.
7. Liability Dream Moment will take all reasonable precautions to provide high-quality services; however, we are not liable for any loss or damage arising from unforeseen circumstances, including but not limited to equipment failure, natural disasters, or accidents.
8. Governing Law These terms and conditions are governed by the laws of India. Any disputes arising from these terms will be subject to the jurisdiction of the courts in Kolkata.
9. Changes to Terms Dream Moment reserves the right to update these terms and conditions at any time. Clients are encouraged to review the terms regularly to stay informed of any changes.
